1. Acceptance of Terms
By downloading, installing, or using the Hercules mobile application ("App") or accessing the Hercules website ("Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App or Website.
2. User Accounts
To use certain features of the App, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
3. Acceptable Use
You agree to use the App and Website only for lawful purposes and in accordance with these Terms. You agree not to: (a) use the App in any way that violates applicable laws or regulations; (b) attempt to gain unauthorized access to any part of the App or its systems; (c) interfere with or disrupt the integrity or performance of the App; (d) collect or harvest any information from other users without their consent; (e) use the App to transmit any harmful, offensive, or objectionable content.
4. Intellectual Property
The App, Website, and all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio clips, and software) are owned by Hercules and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any of our content without prior written consent. "Hercules" and the Hercules logo are trademarks of Hercules. You may not use these marks without our prior written permission.
5. Subscriptions & Payments
Hercules offers both free and premium subscription plans. Premium subscriptions are billed on a recurring basis (monthly or annually) through the App Store or Google Play Store. You may cancel your subscription at any time through your device's app store settings. Cancellation will take effect at the end of the current billing period. Refunds are subject to the policies of the respective app stores.
6. Health & Fitness Disclaimer
The App provides fitness tracking and coaching features for informational purposes only. The content provided through the App, including AI-generated suggestions, is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before starting any new exercise program. Hercules is not responsible for any injury or health issue that may result from using the App.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HERCULES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM: (A) YOUR USE OR INABILITY TO USE THE APP; (B) ANY UNAUTHORIZED ACCESS TO YOUR DATA; (C) ANY THIRD-PARTY CONDUCT ON THE APP; (D) ANY CONTENT OBTAINED FROM THE APP. IN NO EVENT SHALL HERCULES' TOTAL LIABILITY EXCEED THE AMOUNTS PAID BY YOU TO HERCULES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
8. Termination
We may terminate or suspend your account and access to the App at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason. Upon termination, your right to use the App will immediately cease.
9. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on the Website and/or through in-app notifications. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located within the United States.
